The terms on which you may use this website

  • This website tells you about our services. It is not legal or immigration advice.
  • Nobody can guarantee a visa, permit or job. Those decisions belong to governments and employers, not to us.
  • Reviews you submit are moderated before they appear, and we may decline or remove them.
  • Never send money or documents to anyone claiming to be us without confirming through the contact details on this site.
  • These terms are governed by Kenyan law.

1. Who we are, and accepting these terms

This website at diasporatalentcentre.co.ke is operated by Diaspora Talent Centre, of Pioneer Building, Kenyatta Avenue, 3rd Floor, Room 311A, Nairobi, Kenya ("we", "us", "our").

By using this website you accept these terms. If you do not accept them, please do not use the site.

2. What this website is, and is not

This website is an information and enquiry resource. It describes the services we offer and allows you to contact us about them.

Nothing on this website is legal advice, immigration advice or professional advice, and nothing on it creates a lawyer and client relationship or any other professional relationship between us. Immigration requirements, government fees and processing times change frequently and without notice. Information here may be out of date, and it is general rather than tailored to your circumstances.

Before acting on anything you read here, confirm it with us directly, or with the relevant government authority, embassy or a qualified adviser.

3. No guarantee of outcomes

This is the most important term on this page, so it is stated plainly.

We cannot guarantee that any visa, work permit, residence permit, pass, admission, placement or job offer will be granted. Those decisions are made by governments, immigration authorities, embassies, universities and employers, all of whom act independently of us and exercise their own discretion.

What we offer is assistance in preparing, presenting and following up an application competently and on time. Processing times quoted anywhere on this site are indicative estimates based on our experience. They are not promises, and they are outside our control.

Any person who guarantees you an immigration outcome in exchange for money should be treated with great caution. We do not make such guarantees.

4. Engaging our services

Using this website, including sending an enquiry, does not by itself create a contract for services between us. A contract arises only when we and you have agreed the scope of work and the fees in writing.

Fees are quoted for each engagement. Government charges, embassy fees, statutory levies and third party costs are separate from our fees and are normally payable directly to the body concerned.

Where our services involve recruitment for employment outside Kenya, they are provided subject to the licensing and conduct requirements applying to private employment agencies under Kenyan law, including the Labour Institutions Act, 2007 and the National Employment Authority Act, 2016.

Verify before you pay. We will never ask you to send money to a personal account, or to a person or number you have not confirmed with our office. If you receive a request purporting to come from us, telephone us on the number published on our Contact page before sending anything. Report suspected recruitment fraud to the National Employment Authority or to the police.

5. Eligibility

You must be at least 18 years old to submit an enquiry or a review through this website. If you are acting for someone else, you confirm you are authorised to do so.

6. Reviews and other content you submit

6.1 Your responsibility

By submitting a review you confirm that:

  • it reflects your genuine experience of our services;
  • it is your own content and does not infringe anyone else's rights;
  • it is not false, misleading, defamatory, obscene, threatening, discriminatory or unlawful; and
  • it does not contain another person's personal data, or confidential information about any application.

Please do not include passport numbers, identity numbers, case or reference numbers, telephone numbers or email addresses in a review. Approved reviews are public.

6.2 Moderation

Every review is held for moderation and does not appear on the site unless a member of our staff approves it. We may decline, hide or remove any review at our discretion, including for the reasons in clause 6.1. We are not obliged to publish a review, and declining to publish one is not an admission of anything.

6.3 Editing

Our staff can make corrections to a published review, for example to fix a spelling error or remove information that should not be public. Where this happens our systems permanently keep the original wording and record who made the change and when. If you believe a review of yours has been changed in a way that misrepresents what you said, contact us and we will show you the original and correct or remove it.

6.4 Licence

By submitting a review you grant us a non-exclusive, royalty-free licence to publish, display and reproduce it in connection with our business, including on this website and in our marketing. You may withdraw this at any time by asking us to remove the review. Removal applies going forward and does not oblige us to recall material already printed or distributed.

7. Acceptable use

You agree not to:

  • use this website for any unlawful purpose;
  • attempt to gain unauthorised access to any part of the site, its administrative area, its accounts or its underlying systems;
  • interfere with or disrupt the site, or submit content in bulk or by automated means;
  • submit false reviews, or reviews about services you did not receive;
  • copy, scrape or republish substantial parts of the site without our written permission; or
  • impersonate us, our staff, or any other person.

Unauthorised access to, or interference with, a computer system is a criminal offence in Kenya under the Computer Misuse and Cybercrimes Act, 2018. We report serious incidents to the appropriate authorities.

8. Intellectual property

The content of this website, including its text, layout, graphics and the Diaspora Talent Centre name and logo, belongs to us or is used with permission, and is protected by the Copyright Act, 2001 and other laws of Kenya.

You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission.

9. Third party websites

This site links to external websites, including government portals such as eCitizen and embassy and immigration services. Those links are provided for convenience. We do not control those sites, we are not responsible for their content, availability or accuracy, and a link is not an endorsement.

10. Availability

We aim to keep this website available, but we do not guarantee that it will be uninterrupted or error free. We may change, suspend or withdraw any part of it at any time without notice.

11. Limitation of liability

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under the Consumer Protection Act, 2012 where it applies to you.

Subject to that, and so far as the law allows:

  • this website is provided on an "as is" and "as available" basis;
  • we are not liable for any loss arising from reliance on information published on this website, as opposed to advice we give you directly under an agreed engagement;
  • we are not liable for any decision made by a government, immigration authority, embassy, university or employer; and
  • we are not liable for indirect or consequential loss, or for loss of profit, opportunity or expected earnings.

Where we have been engaged to provide a service, our liability is dealt with in the terms of that engagement, not on this page.

12. Indemnity

You agree to indemnify us against any claim, loss or expense arising from content you submit to this website in breach of clause 6, or from your use of the site in breach of clause 7.

13. Privacy

Our Privacy Policy explains what personal data we collect through this website and your rights under the Data Protection Act, 2019. It forms part of these terms.

14. Changes to these terms

We may update these terms from time to time. The effective date at the top shows when they were last revised. Continuing to use the site after a change means you accept the revised terms.

15. Governing law and jurisdiction

These terms, and any dispute arising out of or in connection with them or with your use of this website, are governed by the laws of Kenya.

The courts of Kenya have jurisdiction. Before commencing proceedings, we ask that you raise the matter with us so that we can try to resolve it. The parties may also agree to refer a dispute to mediation.

16. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions continue in full force.
